Terms of Service

1. Agreement to terms

These Terms of Service (“Terms”) govern your access to and use of the Darky Discord bot and web dashboard (together, the “Service”). Darky is operated by an individual based in the Netherlands, not a registered company. By inviting Darky to a Discord server or using the dashboard, you agree to these Terms on behalf of yourself and, if applicable, the server you manage.

2. Eligibility

You must comply with Discord's own Terms of Service and Community Guidelines, and meet Discord's minimum age requirement, to use the Service.

3. Accounts and access

You sign in via Discord OAuth2. You are responsible for maintaining the security of your Discord account and for actions taken through the dashboard using your session. Notify us immediately (see Section 12) of any unauthorized access.

4. Acceptable use

You agree not to:

• Use the Service to violate Discord's Terms of Service, Community Guidelines, or any applicable law.
• Attempt to disrupt, overload, or gain unauthorized access to the Service or its infrastructure.
• Reverse-engineer, resell, or white-label the Service without our written permission.
• Use automation features to spam, harass, or deceive users on Discord or elsewhere.

5. Subscriptions and billing

Paid plans are billed as described on our Pricing page, processed by Lemon Squeezy as merchant of record. Fees are non-refundable except where required by law, or where we cancel or materially degrade a paid feature you already paid for. You can cancel a subscription at any time; cancellation stops future billing but does not refund the current period. We will give at least 30 days' notice before a pricing change applies to your next billing cycle.

6. Service availability

We aim for high availability but do not guarantee the Service will be uninterrupted or error-free. We may suspend or modify features for maintenance, security, or operational reasons, with notice where practical.

7. Termination

You may stop using the Service at any time by removing Darky from your server. We may suspend or terminate access if you violate these Terms, misuse the Service, or if required by Discord or applicable law. Sections that by their nature should survive termination (e.g. limitation of liability) will continue to apply.

8. Disclaimers

The Service is provided “as is” without warranties of any kind, to the fullest extent permitted by law. We do not warrant that moderation, automation, or analytics features will be free of errors or false positives/negatives.

9. Limitation of liability

To the fullest extent permitted by law, we will not be liable for indirect, incidental, or consequential damages arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose.

10. Governing law

These Terms are governed by the laws of the Netherlands, without regard to its conflict-of-laws rules. This does not deprive you of any mandatory consumer-protection rights you have under the law of your own country of residence.

11. Changes to these terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
